These Terms of Use govern the use of the SouthTyrolQuests app (the “App”) and the content provided through it (the “Service”).

1. Provider

2. Scope

(1) These Terms of Use apply to all users of the App.

(2) Any deviating terms proposed by users do not apply unless the Provider expressly agrees to them.

3. Service description

(1) The App enables the use of puzzle tours in which users visit specific locations and solve puzzles there.

(2) Depending on the tour, the App may provide map features, location checks to unlock puzzles, and navigation guidance.

(3) The App is free of charge.

(4) The Provider does not guarantee any particular outcome (e.g., successfully solving all puzzles or error-free availability at all locations).

4. Requirements and proper use

(1) Use requires a compatible device. Certain functions may require an internet connection (e.g., for map content).

(2) Some functions (e.g., on-site unlocking, showing your current position) require enabling location services.

(3) Users are responsible for ensuring their device is sufficiently charged and operational.

5. User obligations, safety, and conduct on site

(1) Users must always comply with applicable laws, traffic rules, and local regulations when using the App.

(2) The App does not replace attention in traffic or in potentially hazardous environments.

(3) Users must not use the App in a way that endangers themselves or others (e.g., using it while driving/cycling without a safe opportunity to stop).

(4) Private property is not part of the tours. Users must nevertheless follow closures, warning notices, and instructions on site.

(5) Users must not alter, remove, damage, or manipulate any objects or items that are necessary to solve a puzzle on site. The same applies to clues, markings, or installations that belong to the tour.

(6) Tours must only be carried out in sufficient daylight. If visibility is not safe (e.g., darkness, dusk, fog, or severe weather), the tour must be paused or not started.

(7) Users undertake not to misuse the App content (e.g., manipulating location data, unauthorized copying of tour content, disrupting the Service).

6. Intellectual property

(1) All rights in the App and in the content (texts, graphics, icons, puzzles, tour concepts, trademarks, logos) belong to the Provider.

7. Availability, changes, and updates

(1) The Provider strives for the highest possible availability but does not guarantee uninterrupted use (e.g., due to maintenance, updates, third-party disruptions, or network issues).

(2) The Provider may modify, further develop, or discontinue the Service and content (e.g., tours, puzzles, map views) for objective reasons (e.g., security updates, bug fixes, legal reasons, outdated content).

8. Third-party services

(1) The App may use third-party services (e.g., map providers such as Google Maps). Additional terms of the third-party providers may apply.

(2) The Provider is not responsible for the availability, content, or data processing of third-party providers; their policies apply.

9. Disclaimers for content and tour information

(1) Content, directions, hints, and location information are created with care but may be incomplete, outdated, or inaccurate due to circumstances (e.g., construction, closures, weather, opening hours).

(2) Users must check on site, on their own responsibility, whether routes are accessible/safe and whether access is permitted.

10. Liability

(1) We are always liable without limitation if we cause damage intentionally or through gross negligence. This also applies to damages resulting from injury to life, body, or health.

(2) In cases of slight negligence, we are liable only if an essential obligation has been breached that is particularly important for using the App. In this case, our liability is limited to the typically foreseeable damage.

(3) We are not liable for issues beyond our control, e.g., GPS inaccuracies, poor network coverage, device settings, or outages of third-party providers (e.g., map providers).

(4) Use of the App in public spaces is at your own responsibility. Please always pay attention to your surroundings and comply with traffic rules and on-site notices. We are not liable for accidents or damage caused by inattentive or risky behavior—unless mandatory law provides otherwise.

11. Privacy

The App collects and processes personal data (e.g., location data for navigation, device identifiers, and usage data). Processing takes place in accordance with our Privacy Policy, which you should read before using the App. In particular, the use of location-based functions requires your explicit consent (e.g., for on-site unlocking of puzzles or navigation).

12. Term and termination

(1) Users may end use at any time by uninstalling the App.

(2) The Provider may block or restrict use if users materially breach these Terms or act abusively.

13. Final provisions

(1) The law of the Republic of Italy applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection rules provide otherwise. For consumers, mandatory provisions of the law of the country in which the consumer has their habitual residence remain unaffected.

(2) If individual provisions are invalid, the validity of the remaining provisions remains unaffected.
